Terms of Use

1. Who we are; agreement to these Terms
This website, conscious.health, is operated by Conscious.Health Management, LLC ("Conscious Health," "we," "us"), a Texas limited liability company that provides administrative and management services. Medical services are provided by Conscious.Health Medical PLLC (the "Practice"), an independently owned Texas medical practice. Using this website does not create a clinician–patient relationship and is not medical advice; that relationship forms only through the Practice's intake and consent process. The Practice, and not Conscious.Health Management, LLC, is solely responsible for the medical care provided to you.
By accessing or using this website, you agree to these Terms of Use and to our Privacy Policy at conscious.health/privacy. When you submit a membership application, book an appointment, or create an account, you will be asked to affirmatively accept these Terms, and your click or electronic signature has the same effect as a handwritten signature. If you do not agree, do not use the website.
If you sign an agreement with us or with the Practice — including a Membership Services Agreement, a Non-Member Patient Services Agreement, or a clinical consent — that signed agreement governs over these Terms wherever the two conflict.
2. Eligibility
Services are available to adults 18 and older located in Texas. The website is accessible from anywhere, but the Practice treats patients only in the states where its clinicians are licensed — today, Texas. Joining the out-of-state notification list does not create eligibility, an application, or a patient relationship; it means we will contact you if services reach your state. We may take reasonable steps to verify age and location.
3. Not for emergencies
Our services are not for medical emergencies. If you are experiencing an emergency, call 911.
4. Membership terms
- Membership is month-to-month, with no minimum commitment.
- Your monthly rate is set when you join and stays locked for as long as your membership is continuous. We may change other aspects of the membership — features, included services, or policies — with at least 30 days' notice, and no change will raise a locked rate mid-relationship. If a change materially reduces your membership, you can cancel as you always can: anytime, effective at the end of your current billing month.
- Founding pricing is defined by enrollment period, not member count. The founding window closes at the Practice's discretion; closing the window never changes the rate of anyone already enrolled.
- Cancellation and refunds are governed by the Billing & Refund Policy at conscious.health/billing, which is part of these Terms.
- Once a prescription has been transmitted to the pharmacy, the order cannot be canceled or refunded. Compounded medications are prepared individually for you and cannot be restocked or resold.
- Compounded medications are prepared for you by state-licensed compounding pharmacies and, like all compounded medications, are not FDA-approved.
5. No guarantee of prescription
Membership and consultations do not guarantee any prescription or treatment. All treatment decisions rest with your clinician based on clinical evaluation and independent medical judgment.
6. Telehealth
The Practice delivers care through telehealth — scheduled video visits and secure messaging through your patient portal — under Chapter 111 of the Texas Occupations Code. Telehealth care is held to the same standard of care as in-person care.
Telehealth has limits worth knowing. Your clinician cannot perform a hands-on physical examination, and may determine that a concern requires in-person evaluation — in that case you will be referred to appropriate in-person care. Technology can fail; if a visit is interrupted, we will reconnect or reschedule promptly, and portal messaging remains available. Laboratory work is completed in person at the laboratory's collection sites.
You will be asked for informed consent to telehealth as part of the Practice's intake process, before care begins. Follow-up care is available through your portal and by scheduling; for anything urgent that is not an emergency, contact the Practice through your portal — and for emergencies, call 911. 7. Text messaging terms
By opting in to text messages from Conscious Health, you agree to receive appointment, account, and program messages from us. Message frequency varies; message and data rates may apply. Reply STOP to opt out, HELP for help, or contact support@conscious.health. Carriers are not liable for delayed or undelivered messages. See our Privacy Policy at conscious.health/privacy for how we handle your information.
8. Accounts, portal use, acceptable use, intellectual property
Your account. You are responsible for the accuracy of the information you provide and for keeping it current. Your clinicians rely on it — including to order your intake laboratory panel from your application before your first visit — so it matters that it is truthful and complete. Keep your login credentials confidential, do not share your account, and tell us right away at support@conscious.health if you suspect unauthorized use.
Acceptable use. Don't use the website or portal to break the law, misrepresent your identity, or infringe anyone's rights. Don't interfere with the site's operation, probe or breach its security, scrape or harvest data, use automated tools to access it, or reverse engineer any part of it. Don't upload malicious code. We may suspend or terminate access for violations.
Intellectual property. The website and its content — text, design, graphics, logos, and trademarks — belong to Conscious.Health Management, LLC or its licensors. We grant you a limited, revocable, non-exclusive license to use the site for personal, non-commercial purposes. "Conscious Health" and our logos are our trademarks; nothing here grants a license to use them. If you send us feedback or suggestions, we may use them without restriction or compensation. To report content you believe infringes your copyright, email support@conscious.health.
Third-party services. Care may involve third parties — laboratories, pharmacies, our supplement dispensary — that operate under their own terms and privacy policies, which govern your use of their services.
9. Payment terms
Payments are governed by the Billing & Refund Policy at conscious.health/billing, which is part of these Terms. By enrolling in membership you authorize recurring monthly charges to your payment method until you cancel. Prices are in U.S. dollars; applicable taxes may be added where required.
10. Disclaimers; limitation of liability; indemnification
Website disclaimer. The website and its content are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. Content on the website is general information, not medical advice, and is not a substitute for care from a licensed clinician. We do not warrant that the website will be uninterrupted, error-free, or secure.
What this section does not do. Nothing in these Terms limits or disclaims the Practice's responsibility for the medical care its clinicians provide, or any liability that cannot be limited or disclaimed under applicable law — including liability for gross negligence or willful misconduct. Claims relating to medical care are governed by your signed agreements with the Practice and by applicable law, not by this section.
Limitation of liability. To the fullest extent permitted by law, Conscious.Health Management, LLC's total liability for claims arising out of the website or these Terms will not exceed the greater of the amounts you paid us in the twelve months before the claim arose or $100, and we will not be liable for indirect, incidental, consequential, or punitive damages, or lost profits.
Indemnification. You agree to indemnify Conscious.Health Management, LLC against third-party claims, and the reasonable costs of defending them, to the extent caused by your violation of these Terms, your misuse of the website, or your infringement of another's rights.
11. Governing law; dispute resolution
These Terms are governed by Texas law, without regard to conflict-of-laws rules.
Talk to us first. Before filing any claim, email support@conscious.health with a description of the issue; we will try to resolve it informally within 30 days. Most issues resolve in one exchange.
Arbitration of website and billing disputes. Except as set out below, any dispute arising out of the website, these Terms, or billing and payment matters will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, in Austin, Texas, or remotely at your election. Judgment on the award may be entered in any court with jurisdiction.
What arbitration does not cover. Claims relating to medical care, health care services, or health care liability are not subject to this arbitration section; they are governed by your signed agreements with the Practice and by applicable law. Either party may also bring an individual claim in small claims court, and we may seek injunctive relief in court for infringement or misuse of the website or our intellectual property.
Class waiver. Arbitrable claims must be brought individually — not as a plaintiff or class member in any class, consolidated, or representative proceeding. If this class waiver is found unenforceable as to a claim, that claim (and only that claim) proceeds in court.
Opt-out. You may opt out of this arbitration provision by emailing support@conscious.health with the subject "Arbitration opt-out" within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
Court proceedings. Any claim not subject to arbitration will be brought in the state or federal courts sitting in Travis County, Texas, and the parties consent to their jurisdiction. If you have signed an agreement with us or the Practice containing a different dispute-resolution provision, that provision governs the claims it covers.
12. Changes to these Terms
We may update these Terms. Material changes take effect 30 days after we post them and notify you — by email or a notice on the site — and continued use after that date is acceptance. No change will raise a locked membership rate mid-relationship. The current version is always at conscious.health/terms.
13. General
If a provision of these Terms is found unenforceable, the rest remain in effect. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may assign them to an affiliate or successor. These Terms, the Privacy Policy, the Billing & Refund Policy, and any signed agreements between you and us or the Practice are the entire agreement — and where a signed agreement conflicts with these Terms, the signed agreement governs.
